Unfair Dismissal Under Malaysian Law
Under the Industrial Relations Act 1967, an employee may not be dismissed "without just cause or excuse." Ending employment on contractual notice alone does not automatically amount to just cause. An employee who believes they were unfairly dismissed may file a representation with the Director General of Industrial Relations within 60 days of the dismissal. If conciliation does not resolve the matter, it may be referred to the Industrial Court, which can order reinstatement, or compensation and back wages of up to 24 months.
