Grant of Probate or Letters of Administration
The right route depends mainly on whether the deceased left a will. Where there is a valid will, the executor named in it applies to the High Court for a Grant of Probate, which confirms their authority to administer the estate. Where there is no will, the estate is dealt with through Letters of Administration, and an administrator is appointed instead. The route for this can differ depending on the size of the estate and the type of assets involved, with smaller estates sometimes handled through the Land Office under the Small Estates (Distribution) Act 1955. Where a person dies without a will, their assets are distributed according to the Distribution Act 1958.
